Welcome to TurkeyWithDoctors.com (“us,” “we,” “Site” or “TWD). This Terms of Use Agreement (“Agreement”) governs your access to, and use of, TWD and the information, profiles, materials and other content (“Content”) available on or through TWD. Please read this Agreement carefully before using the Site or any of its Content. By choosing to use the Site you acknowledge that you have read this Agreement and the disclaimers and caveats contained in TWD, and that you accept and will be bound by the terms thereof. IF YOU DO NOT AGREE WITH THE TERMS OF THIS AGREEMENT, YOU ARE NOT GRANTED PERMISSION BY TWD TO ACCESS THE CONTENT OF THE SITE. If you do not agree to all of these terms and conditions of use, do not use the Site!

TWD is based in Antalya, in Turkey. TWD makes no claims that the Content is appropriate or may be downloaded outside of Turkey. Access to the Content may not be legal by certain persons or in certain countries. If you access the Site from that countries, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

General Definitions and provisions

3. User: Real persons who have full legal capacity to access the services provided by TWD by accepting the Terms of Use and completing the registration process.

4. Professional: Doctor, dentist, psychologist, physiotherapist, midwife, obstetrician, dietitian, therapist, veterinarian, as well as users who carry out other professions not mentioned above.

5. Instutions: These are the establishments where medical services are provided.(such as hospitals, clinics)

6. Owner: The status given to the User who has the authority to manage information about the organization.

7. Profile: It is the place where information and opinions about any instiution or Professional are collected on the Site.

8. Account: Site database entry that allows the identification of users or professionals with the help of a user name and password, thus enabling them to access certain services.

9. Service: The service provided in electronic environment is based on the process of data exchange through public information and telecommunication systems in line with the request of the service recipient (User). The parties do not need to be present at the same time.

10. TWD provides the Services in accordance with this Terms of Use.

11. The Terms of Use are binding for the User, without the need to sign any additional contracts.

2.Types and Scopes of Services

4. Making notifications about new information and reviews,

5. Providing professionals with the opportunity to enter and edit information about them, as well as to respond to Users’ reviews,

6. Most of the services provided on the site are free. There is no fee for registration and entering basic information about Professionals and Institutions.

7. TWD reserves the right to charge any of the services provided under the Site and is also obliged to notify such changes in advance.

3. Requirements for using the services

5. Information and reviews about Professionals and Institutions are publicly accessible and anyone can use the search engine.

11. Login is possible after the user is registered. To login, the Username (e-mail address) and password determined during registration are entered.

12. The service of sending notifications about new information and opinions is activated by marking the desired Professionals and Institutions as followed.

13. TWD reserves the right to temporarily interrupt the delivery of the Services during the modernization of the Site or the maintenance work to be carried out in the telecommunication systems.

14. TWD cannot be held responsible for the disruptions in the delivery of the Services for reasons that are not in their hands.

15. TWD cannot be held responsible for the Professional or the Institution as the User does not attend the appointment. TWD cannot be held liable to the User for the lack of health care due to Professional or Institutional reasons. In case of a situation that prevents the appointment to occur, the parties are obliged to inform the other party about the situation by phone.

4. Adding Reviews and Informations on Professionals and Institutions

1. Reviews (patient satisfaction comments & ratings) can only be obtained from users who have registered on the site. Users can use nick name if they wish.

2. Reviews and informations about professionals may only be related to the Professional’s professional life and the satisfaction level of the patient’s service.

3. Reviews and information about Professionals and Organizations can only be based on User’s personal experience. They cannot be based on the narrations of third parties. Exceptions to this rule are parents or guardians who treat their children, relatives who are mentally unstable (or somehow disabled to share their opinions on the platform under the Convention) or elderly people in need of care.

4. The user is not allowed to give more than one opinion on the same medical procedure (examination, analysis, medical procedure, etc.).

5. It is strictly forbidden to publish content that is partly or wholly within the scope of announcements, advertisements and similar activities or other prohibitions of the relevant legislation or that aims to advertise or promote any third party or institution.

6. Information, opinions and comments cannot be against the laws and social life rules.

7. It is forbidden to use obscene, cursing and insulting words, derogatory metaphors and nicknames, and to give information about the private and family life of the professional.

8. It is forbidden to make allegations that crimes have been committed and to call for violence and hate based on racial, religious, ethnic and similar differences.

9. The user accepts and undertakes that he / she is responsible in person and exclusively for the correctness of the information it adds or whether it violates the rights of third parties.

10. TWD reserves the right to refuse the publication of reviews and information that violate the Terms of Use or the law and to delete the currently published ones.

11. TWD cannot be held responsible for the content, information and comments entered by Users or Professionals.

12. It is strictly forbidden for the Professional to manipulate the comments of himself or other users and / or comment on his profile.

13. Users cannot make any false statements in their profiles or in the profiles of others.

5. Professionals Profiles, Verified Profiles

1. To create a profile for a new Professional, at least basic information about that Professional must be entered.

2. Basic information about the professional includes: Professional title, name, surname, province, city, the category of the professional, as well as the address and contact information of the place where the patient accepts.

3. Each professional has only one Profile. Several Professionals are not allowed to open a common profile. Duplicate Profiles will be deleted.

4. Information other than the name and surname of a single Professional cannot be entered in the fields where first and last names must be entered. The following information is not allowed in these fields: Company, practice or healthcare institution name.

5. Each Professional can create or confirm its own Profile. Registration is required for this purpose.

6. Profile created or confirmed by the professional will be marked as “Verified profile”.

7. A Professional with a Verified Profile has additional powers. This Professional may perform the following operations, provided that it complies with the remaining terms and is not limited to:

1. can edit the information about it,

2. can add profile photo,

3. respond to comments entered by users,

4. can see the statistics of visiting.

8. The professional can only add a photo of his own that allows it to be recognized.

9. The Professional agrees and declares that his/her/its personal information placed on the Site is publicly published.

10. A non-exclusive, permanent and free of charge, with the use of, but not limited to, those in terms of the TWD and the means of processing, reproduction, dissemination, representation, signaling, sound and / or image transmission as specified in the Law No. 5846 on Intellectual and Artistic Works. Professional accepts and declares that it will have provided an intellectual property license. Deleting the account will not change this situation.

11. It is forbidden to add photographs of others and other non-photograph graphics. Retouching on these photos is allowed, taking into account the characteristics of digital photos. However, these retouches should only be for enhancing the overall quality of the photo (eg color, contrast). Operations such as removing or adding some elements from the photos, merging multiple photos or changing the original compositions of the photo are not allowed. It is prohibited to add pornographic photographs or photographs that do not comply with the professional nature of the Site.

12. Photos that do not meet the above requirements may be deleted by the TWD without any warning or notification to the Professional.

13. TWD has the right to refuse the publication of information that appears to be false and to delete any already published information.

6. Organization Profiles, Verified Profiles

1. Basic information about the organization includes: Name, category, city, address and contact information of the health institution.

2. In order to create a new Organization Profile, at least basic information about that Organization must be entered.

3. Each organization has only one Profile. It is not allowed to open a common Profile for more than one Organization. Duplicate Profiles will be deleted.

4. The Organization Profile can only relate to the organization located at one address. If the health unit has more than one branch, a separate profile can be opened for each branch.

5. Each Owner can create or confirm the Profile of his or her own Organization. Registration is required for this purpose.

6. The Profile created or confirmed by the owner will be marked as “Verified Profile”.

7. The Owner has additional powers in the Confirmed Organization Profile. This Owner may take the following actions, provided that it complies with the remaining terms and is not limited to:

1. can edit the information about it,

2. can add profile logo,

3. respond to comments entered by users,

4. can see the statistics of visiting.

8. The owner can only add the logo of the institution he is the manager of. It also allows the publication of the logo placed on the Site by itself. It is forbidden to add unsuitable photos to the site. Logos that do not meet the above conditions may be deleted by TWD without any warning or notification to the Manager.

9. The Service Provider has the right to refuse the publication of information that appears to be false and to delete any already published information.

7. Terms Regarding Making and Termination of Service Contract

1. The Agreement becomes valid by registering on the Site and activating the Account.

2. By registering the account, the User registering accepts the terms of this Terms of Use and undertakes to comply with these terms.

3. If the User ceases to accept any provision in the Terms of Use, it is obliged to delete its Account immediately or notify TWD about this situation.

4. The Service Provider will enable Users and Professionals to access, correct and supplement their information. Service Provider does not make the information available to third parties without the consent of the User or Professional. This does not include requests from official authorities with appropriate powers.

5. During the Professional registration, along with the information required for the User registration, the professional authority registration number and T.C. ID Number must also be entered. Those who work without the need of a special authority should send the copies of their diplomas and identity cards that they receive with the scanner. The registration numbers and document copies entered will be used only to confirm that the Professional has the necessary powers.

6. Every User or Professional, who can prove that he is authorized to manage the profile page prepared according to the names in the database, can obtain the Owner status.

7. In case of doubt about the correctness of the information entered by the user, TWD may request that the appropriate documents confirming the accuracy of this information be submitted.

8. When the registration process is performed on the site, it is permitted to process the personal information of the User and the Professional in the registration form and the information published in the Profiles created by them.

9. By registering on the site and activating the Account, the User, Professional or Owner;

1. Declares that it has read and accepted the entire content of the Terms of Use,

2. Accepts processing of personal information and posting of Professional information in Profile in accordance with the provisions of this Terms of Use,

3. It declares that the information entered in the registration form is correct,

4. It agrees to send system messages to the e-mail address specified in the registration form, messages regarding the malfunctions in the operation of the Site, notifications about changes in the Terms of Use, information about new functions and commercial information.

5. It accepts SMS, e-mail, phone call and all kinds of electronic messages for appointment confirmation, reminder, promotion and information

10. Opening more than one Account is not allowed.

11. It is forbidden to make the account available to third parties.

12. It is forbidden to make use of third party accounts.

13. The contract is made indefinitely.

14. The User, Professional or Owner may terminate the contract by deleting their account. Deleting the account of the Professional or Organization does not delete the Profile.

15. Each of the parties may terminate the service provision contract electronically, without giving any reason and warning.

16. TWD reserves the right to terminate the contract by deleting the account, if the actions of the User or the Professional are against the law and the Terms of Use or that may damage the site’s reputation.

17. TWD reserves the right to make changes in services, tools and the way the Site works, to delete all information contained in its databases, to terminate its activities, to transfer the Site’s rights and to take any action regarding the Site in accordance with the law. The user cannot claim any compensation from TWD regarding the specified transactions.

8. Responsibility

1. TWD do not take any responsibility for the content and structure of the information and materials placed on the Site by the User or the Professional. The user accepts and undertakes that he / she is responsible in person and exclusively for the correctness of the information it adds or whether it violates the rights of third parties.

2. The User or Professional is fully responsible for any damages and unlawful actions that may arise from their actions on the Site. These actions include, but are not limited to, providing inaccurate information, disclosure of professional secrets or other secrets, violation of personal rights or copyrights or similar rights, and a prohibition of advertisement.

3. TWD clearly and explicitly states that the risks that may arise from the use and use of the Services provided by the Site belong only to the User or the Professional. No guarantee is given regarding the information and materials placed on the Site, as well as the values, usefulness, completeness, completeness and usefulness of the products and services provided through the Site.

4. TWD does not accept any responsibility for the quality or physical quality of the services and products offered free of charge. It does not have any responsibility for not fulfilling or fulfilling the commitments made by any person through the site or whether they are authorized to make commitments.

5. The responsibilities of the TWD regarding the quality of the goods and services supplied for a fee are determined by the articles of law regarding paid services.

6. TWD does not provide any guarantee that the whole or part of the Site will operate without error.

7. If a notification is received from a government official that the information of a particular User, Professional or Owner is against the law, and access to this information is blocked, the Service Provider will not be liable for any damages that may arise due to the blocking of access to this information. cannot be held responsible.

9. Complaint Notification Form and Appeal / Return Procedure

1. TWD will make every reasonable effort to ensure the correct functioning of the Site and will support the solution of the problems related to the operation of the Site.

2. Complaints about the reliability of the opinions reported on the site are sent using the “Report Complaint” button next to the comment.

3. Other warnings, complaints, suggestions and errors can be communicated using the Contact link at the bottom of each page.

4. Replies to complaints will be sent to the User’s or Professional’s e-mail address as soon as possible.

5. Problems in the operation of the site, problems and complaints about the services provided from the Site can be sent to the following address by the User or the Professional within 14 days: support@turkeywithdoctors.com

6. These complaints are processed within 14 days of submission. If this is not possible within this period, TWD will notify the reason for this delay and the new period before this period expires.

7. TWD reserves the right not to process this complaint if the complaint has arisen due to the unknownness of this Terms of Use, annexes of the Terms of Use or the provisions of the laws.

8. It is only possible to file claims for compensation to the courts if the Complaint / Appeal / Return procedure fails.

10. Final Provisions

1. TWD has the right to change the Terms of Use unilaterally. Prior to such a change, Users and Professionals will be notified of these changes with a notification sent to their e-mail addresses during registration.

2. The User and the Professional are responsible for the situations that arise as a result of giving an e-mail address that does not have access, faulty or belong to someone else, and in particular not to receive the notification specified in Article 1.

3. The relationship between the parties is regulated by the laws of the Republic of Turkey.

4. The relevant legislation provisions are binding on matters not covered by the Terms of Use.

5. Courts in the location of the TWD’S headquarters are authorized to resolve disputes related to the Services Provided.

6. This Terms of Use invalidates the terms of the previous Terms of Use and takes effect on the day of publication on the Site.
